The following General Terms and Conditions (hereinafter referred to as "GTC") apply to all business relationships between Pericintas GmbH (hereinafter referred to as "Pericintas GmbH" or "Contractor") and the customers (hereinafter referred to as "Customer" or "Client") for all services offered via the website or specifically agreed with the Customer.

Individual agreements concluded with the customer shall take precedence over these GTC. Conflicting terms and conditions of the customer are not recognized.
Pericintas GmbH reserves the right to amend these GTC at any time. All changes shall become effective upon publication of the new GTC on the website. The relevant date for the applicability of the valid GTC is the date of acceptance of the offer.
By accepting the offer, you agree to the following conditions and our privacy policy. You Next declare that you are authorized to conclude legally binding contracts and are at least 18 years old.
Coaching and consulting services are provided on the basis of the programs offered on the website. It is based on cooperation and mutual trust. Success cannot be guaranteed. The contractor supports the client in making decisions and changes. However, the change itself must be made by the client on their own responsibility.
The contract is concluded upon acceptance of the Contractor's offer. The contract is also concluded when the customer makes use of the services offered by the contractor.
Subject to other offers and agreements, all prices are quoted in Swiss francs (CHF). All prices are exclusive of value added tax (VAT). Subject to separate agreements, the price quoted on the website is payable. In the event that the price cannot be determined, an hourly rate of CHF 500.00 shall apply, plus any VAT.
The customer undertakes to pay the invoice in advance within 10 days of the invoice being issued, but no later than 48 hours before the service is provided (advance payment). The Contractor is not obliged to provide services without advance payment. If payment is not received by the Contractor on time, the Customer shall automatically be in default. The Contractor may charge a fee of CHF 20.00 per reminder for reminders.
Both parties have the right to terminate the contract at any time. The Contractor shall be compensated in full for expenses already incurred at an hourly rate of CHF 500.00 plus any applicable VAT. Termination at an inopportune time is not permitted. In this case, the customer remains obliged to pay the full price in any case. This shall apply in particular in the event of last-minute cancellations of consultancy appointments.
The activity is purely a service activity. Success is neither guaranteed nor owed. To the extent permitted by law (Art. 100 para. 1 OR; Art. 101 para. 2 OR), any liability is excluded.
The Contractor may process and use the data collected during the conclusion of the contract to fulfill the obligations arising from the contract. The Customer declares its full consent to the storage and contractual use of its data by the Contractor. If the customer has not expressly prohibited it, the contractor may use the data for marketing purposes.
Should a provision of this contract or a supplement to this contract be or become invalid, this shall not affect the validity of the remainder of the contract.
The contracting parties shall replace the invalid provision with a valid provision that comes as close as possible to the intended economic purpose of the invalid provision. The same shall also apply to any contractual loopholes.
These GTC are subject to Swiss law. Appenzell is agreed as the exclusive place of jurisdiction.
The United Nations Convention on Contracts for the International Sale of Goods (SR 0.221.221.1) is explicitly excluded.
